A Delaware Corporation
These Terms of Service (“Terms”, “Agreement”) govern your access to and use of the Nmbr platform, applications, tools, and related services (“Nmbr”, “Service”, “we”, “us”, “our”). By using Nmbr, you agree to be bound by these Terms and our Privacy Policy.
Nmbr provides technology services that automate rental search, verification, pricing guidance, leasing workflows, and payment processes through AI-assisted automation. Nmbr is not a real estate broker, agent, or property manager under any federal or state law unless explicitly agreed in writing.
1. Definitions
Landlord – a property owner or authorized representative listing or managing a rental unit through Nmbr.
Tenant – an individual applying to rent a property through Nmbr.
Listing – any rental property submitted, published, or managed via Nmbr.
Verification – identity, income, employment, background, and related checks.
Subscription Plan – any paid Nmbr plan available to Landlords or Tenants.
Offer – AI-generated pricing or leasing guidance.
Lease Agreement – the rental contract between Landlord and Tenant. Nmbr is not a party unless expressly stated.
Refund Policy – the policy that explains when subscription payments may be cancelled, credited, or refunded.
AI Recommendations – automated outputs generated by Nmbr; not legal or housing advice.
2. Eligibility
You may use Nmbr only if you:
- Are at least 18 years old;
- Have legal capacity to enter binding agreements;
- Have authority to submit rental applications or property listings;
- Comply with all housing, rental, and consumer reporting laws.
Nmbr may restrict service at any time for compliance or risk reasons.
3. Nmbr's Role
Nmbr provides:
- automated tenant verification
- AI-assisted pricing suggestions
- rental matching and screening tools
- digital contract workflows
- payment setup and processing
- optional paid benefits described at purchase
Nmbr does not:
- act as a real estate broker or agent
- guarantee acceptance or approval of applications
- ensure property condition, safety, repairs, or habitability
- mediate disputes
- provide legal or housing advice
4. User Responsibilities
4.1 Landlords
Landlords agree to:
- provide accurate and lawful listing information
- comply with fair housing and rental laws
- cooperate with verification processes
- use Nmbr for lawful rental purposes
4.2 Tenants
Tenants agree to:
- provide accurate personal and financial information
- consent to verification checks
- apply only for properties they intend to lease
- avoid fraud or misuse of the Service
5. Verification
Nmbr may use internal systems and external partners to verify:
- identity
- income
- employment
- background
- rental history
Nmbr does not guarantee accuracy or approval.
6. Fees and Payments
Nmbr offers paid Subscription Plans available to both Landlords and Tenants.
6.1 Subscription Billing
Subscription Plans may renew monthly or quarterly depending on the user's selection.
6.2 Automatic Renewal
All subscriptions renew automatically unless cancelled.
6.3 Pricing Flexibility
Subscription pricing may change. Continued use after updates constitutes acceptance.
6.4 Refunds & Cancellations
Refunds and cancellations are governed by the Nmbr Refund Policy.
Nmbr may also display plan-specific refund terms at checkout. If plan-specific terms conflict with the Refund Policy, the terms shown at purchase control for that plan.
6.5 Payment Processing
All payments are processed via third-party payment providers. Nmbr does not store complete card details.
7. No Damage Protection
Nmbr does not provide:
- property damage coverage
- habitability guarantees
- repair reimbursement
- landlord or tenant insurance
unless explicitly stated in a written agreement.
8. AI Disclaimer
Nmbr uses AI to automate communication, recommendations, and screening insights.
AI outputs may be incomplete or contain errors and do not constitute legal, financial, or housing advice.
Users remain fully responsible for decisions and compliance.
9. Limitations of Liability
To the maximum extent allowed by law:
- Nmbr's liability is limited to the amount paid by the user in the last 12 months
- For users who have not paid any amount, liability is capped at USD $50
- Nmbr is not liable for indirect, incidental, special, or consequential damages
- The Service is provided “as-is” and “as-available”
Nmbr is not responsible for:
- lease performance
- eviction or disputes
- property condition
- third-party errors
- fraud by users
10. Additional Paid Features
Some Nmbr plans may include additional paid features, workflow support, or service benefits. Any additional paid feature applies only when it is expressly included in your selected plan or confirmed by Nmbr in writing.
Nmbr does not provide insurance, legal representation, property management, or a guarantee of tenant behavior unless expressly required by law or agreed in a separate written agreement.
11. Termination
11.1 By User
You may close your account at any time.
Subscription charges remain non-refundable unless the Refund Policy, the purchase flow, or applicable law provides otherwise.
11.2 By Nmbr
Nmbr may suspend or terminate accounts for:
- fraud
- non-payment
- misuse
- legal violations
- risk or compliance concerns
11.3 Survival
The following survive termination: Liability, Dispute Resolution, Governing Law, Privacy, Fees due, Modifications.
12. Dispute Resolution & Governing Law
This Agreement is governed by the laws of the State of Delaware.
Users agree to:
- exclusive jurisdiction in Delaware courts
- jury trial waiver
- class action waiver
- individual dispute resolution
13. Modifications
Nmbr may update these Terms at any time.
Continued use constitutes acceptance.
14. Privacy
Use of the Service is governed by the Nmbr Privacy Policy.
15. Entire Agreement
These Terms, together with:
constitute the entire agreement between you and Nmbr.
